1. Parties
This Agreement is between you (the 'Client') and OFinancial LLC, regulated by the Financial Services Commission of Mauritius (Licence Number GB25205138), a service-provider entity within the OMNI Markets LLC group ('OFinancial', 'we', 'us', 'our').
2. Scope of Services
OFinancial provides execution-only dealing in contracts for difference (CFDs) and spot derivatives across the asset classes published on our website. We do not provide investment advice, portfolio management, or tax advice.
Trading is conducted on the MetaTrader 5 platform. The pricing displayed is sourced from our liquidity providers; execution is on a straight-through processing basis.
3. Client Classification
You will be classified as a retail client by default unless you qualify and elect for professional client status. Retail clients receive the highest level of regulatory protection including negative balance protection and segregation of client funds.
4. Orders, Execution & Slippage
Orders are routed directly to liquidity providers. Filled prices may differ from quoted prices due to market volatility, gapping or liquidity. We pursue best execution within the confines of available market conditions.
We do not internalise client orders against our own book. We do not requote prices.
5. Margin & Leverage
You must maintain sufficient margin at all times. Where account equity falls below maintenance margin, positions may be closed automatically (stop-out) according to our published margin-call and stop-out levels.
Maximum leverage varies by asset class and account equity. Refer to the Symbol Specifications and Leverage pages for details.
6. Client Money
Client funds are held in segregated accounts at tier-1 banks, separate from the company's operating capital. Funds are not used for any purpose other than client trading activity.
Retail clients benefit from negative balance protection. You will not be required to deposit additional funds beyond your account balance to settle any losses.
7. Communications
We will communicate with you in English by email, by secure message in your client area, or by telephone where you have requested it.
It is your responsibility to keep your contact details updated.
8. Complaints
Complaints should be sent in writing to complaints@ofinancial.markets. We will acknowledge within 2 business days and aim to provide a final response within 8 weeks. Unresolved complaints may be escalated to the FSC of Mauritius.
9. Termination
Either party may terminate this Agreement with 30 days' notice. We may terminate without notice in cases of fraud, breach of these terms, or where required by law or regulation.
Open positions at termination will be closed at the next available market price.
10. Governing Law & Jurisdiction
This Agreement is governed by the laws of Mauritius and is subject to the exclusive jurisdiction of the courts of Mauritius.
